Parents' Bill of Rights for Data Privacy and Security

This document is provided in accordance with New York Education Law Section 2-d and its implementing regulations. It describes the rights of parents and eligible students regarding the privacy and security of student data collected through SELChat™.

1. What Student Data We Collect

SELChat™ collects the following student data:

  • Account Information: Name, email address, username
  • Age Verification Data: Student's age (to ensure COPPA compliance)
  • Parent/Guardian Email: For students under 13 (for consent and communication)
  • Scenario Responses: Choices made and dialogue written during social-emotional learning simulations
  • Progress Data: Scenarios completed, time spent, endings reached, behavioral patterns identified
  • Technical Data: Browser type, IP address (for security and functionality purposes only)

2. How We Use Student Data

Student data is used exclusively for the following educational purposes:

  • Personalized Learning: To adapt scenario difficulty and content to the student's skill level
  • Progress Tracking: To record and display student progress to teachers, counselors, and parents
  • AI Scenario Generation: To generate realistic, age-appropriate dialogue and feedback through our AI system
  • Behavioral Insights: To provide constructive feedback on communication patterns and social-emotional growth

3. Who We Share Data With

We share student data only with the following third-party service providers, solely for the purpose of delivering our educational services:

  • AI Processing (OpenAI / Abacus.AI): Scenario responses are processed by AI models to generate realistic character dialogue and behavioral feedback. Data is transmitted securely and is not retained by the AI provider for training purposes.
  • Payment Processing (Stripe): If a school or parent purchases a subscription, payment information is processed by Stripe. We do not store credit card numbers.

4. How Parents Can Access Their Child's Data

Parents and legal guardians have the right to inspect and review their child's personally identifiable information (PII) stored by SELChat™. To request access:

We will respond to all data access requests within 10 business days.

5. How Parents Can Delete Their Child's Data

Parents may request deletion of their child's data at any time by:

  • Emailing [email protected] with the subject line "Data Deletion Request"
  • Submitting a request through our Privacy Request Form
  • Using the "Delete My Account and Data" button available in the student's Account Settings

All data will be permanently deleted within 30 days of the request. A confirmation email will be sent upon completion.

6. Data Breach Notification Policy

In the event of a data breach affecting student data, NextGenEd Solutions LLC will:

  • Notify affected parents, guardians, and schools within 10 business days of discovering the breach
  • Provide details about what data was affected
  • Explain the steps being taken to contain and remediate the breach
  • Offer guidance on protective measures parents and students can take

Notifications will be sent via email to the address on file for each affected user.

7. Data Security Measures

We implement industry-standard security measures to protect student data, including:

  • Encryption: All data is encrypted in transit (TLS/SSL) and at rest
  • Secure Servers: Data is hosted on secure, access-controlled cloud infrastructure
  • Limited Access: Only authorized personnel with a legitimate educational need can access student data
  • Regular Audits: We conduct periodic security reviews and vulnerability assessments
  • Password Protection: All passwords are hashed using industry-standard bcrypt encryption

8. Data Retention Policy

Our data retention practices are as follows:

  • Active Accounts: Student data is retained while the account is active and in use
  • Account Closure: When a student or school account is closed, all personally identifiable information is deleted within 30 days
  • Anonymized Data: Only anonymized, aggregated data (containing no personally identifiable information) may be retained for service improvement purposes
  • School Contracts: Data retention may be subject to additional terms outlined in agreements with individual schools or districts
